Subject of administration: The General Administration of Customs is in charge of the supervision and administration of export food safety throughout the country. The customs at all levels shall be responsible for the supervision and administration of export food safety in the areas under their jurisdiction.

Objects of administration: the production and marketing activities of export food carried out by export food producers and traders.

Attention!! Food additives (such as sorbate, xylitol, etc.) and food-related products (such as tableware, etc.) do not fall under the category of export food.

According to the Measures for the Administration of Import and Export Food Safety of the People’s Republic of China, the Customs implements supervision and administration of export food according to law, and its measures mainly include: the recording of export food raw material cultivation farms, the recording of export food production enterprises, enterprise verification, document verification, on-site inspection, supervision and sampling inspection, port sampling inspection, overseas notification and verification, and a combination of various.

The following is a brief description of the various regulatory measures:

1, the export of food raw materials planting farm record

The General Administration of Customs uniformly promulgates the list of raw material planting and breeding farms for filing, and formulates filing procedures and requirements. The local customs is responsible for the record of planting and breeding farms of export food raw materials, and supervises the record of planting and breeding farms of raw materials by means of data review, on-site inspection and enterprise verification.

2, Record of export food production enterprises

The General Administration of Customs shall formulate filing procedures and requirements, and the local customs shall be responsible for the filing of export food production enterprises.

Where overseas countries (regions) implement registration administration for export food production enterprises exported from China to that country (region) and require the recommendation of the General Administration of Customs, the export food production enterprises shall submit an application to the local customs, and the local customs shall conduct preliminary verification and report it to the General Administration of Customs. The General Administration of Customs shall organize and carry out the work of foreign recommendation registration in combination with the credit of enterprises, supervision and management, and the initial verification of the local customs, and the procedures and requirements for foreign recommendation shall be formulated by the General Administration of Customs.

3, enterprise verification and document review

Export food production enterprises shall establish supplier evaluation system, purchase inspection record system, production record file system, factory inspection record system, export food traceability system and unqualified food disposal system. Export food production enterprises shall mark the record number of the production enterprise, product name, production batch number and production date on the transport packaging.

The Customs shall supervise and inspect the operation of the food safety and hygiene control system of the export food production enterprises under its jurisdiction. It can be carried out by means of data review, on-site inspection, enterprise verification, etc., and can be combined with the work of overseas notification and verification of exported food, supervision and sampling inspection, and on-site inspection.

4, On-site inspection, supervision and random inspection at ports

Export food production enterprises and exporters shall, in accordance with laws, administrative regulations and the provisions of the General Administration of Customs, file an application for supervision before export declaration with the customs of the place of origin or the place of shipment. After accepting the application for supervision before the food export declaration, the customs of the origin or the place of shipment shall, according to law, carry out on-site inspection and supervised sampling of the export food that needs to be inspected and quarantinable. If the exported food meets the requirements through on-site inspection and random inspection under the supervision of the Customs, the Customs shall issue a certificate and permit the export. If the exported food fails to meet the requirements through on-site inspection and random inspection under customs supervision, the Customs shall notify the exporter or his agent in writing. If the relevant export food can be subjected to technical treatment, it shall not be allowed to export until it passes the technical treatment; Any product that cannot be subjected to technical treatment or is still unqualified after technical treatment shall not be allowed to be exported.

5, Overseas notification and verification

Where export food is notified of safety problems by international organizations or overseas government agencies, the General Administration of Customs shall organize to carry out verification, and implement control measures such as adjusting the proportion of supervision sampling inspection, requiring food exporters to submit inspection reports issued by inspection agencies to the Customs batch by batch, and withdrawing registration recommendations to overseas official competent agencies. Where the customs at all levels find any safety problem during the implementation of export food supervision and administration, it shall inform the government at the same level and the competent food safety department of the government at the next higher level.

On the basis of the above supervision and management, the Customs has also established a food safety information management system:

The General Administration of Customs shall collect and summarize export food safety information and establish export food safety information management system. The customs at all levels shall be responsible for the collection and collation of export food safety information designated by the customs within their respective jurisdictions and at higher levels, and shall inform the local governments, relevant departments, institutions and enterprises under their respective jurisdictions in accordance with relevant provisions. Where the information notified involves other regions, the customs of the relevant regions shall be notified at the same time. The Customs shall conduct risk investigation and judgment on the collected import and export food safety information, and determine the corresponding control measures according to the results of risk investigation and judgment.
